Article 249 EC states clearly that recommendations and opinions are
to have no binding force. While this precludes such measures from having direct
effect, it does not immunize them from the judicial process.

It is, for example, open to a national court to make a reference to the ECJ concerning the interpretation or validity of such a measure.Article 211 gives the Commission a general power to formulate
recommendations or deliver opinions on matters dealt with in the Treaty, either where it expressly so provides or where the Commission believes that it is necessary to do so.
